Digital content creator Brian Mutinda is finally breaking his silence after his legal battle with US-based Kenyan artiste Nonini.

Mutinda is recounting how using the artist's music without consulting or permission from the creator cost him over Sh1 million.

He has advised other social media influencers and digital content creators on using music without permission.

 

Brian also had to pull down the company he was marketing had to pull down advert as it still contains Nonini's music.

Speaking during an interview with Tuko, Mutinda urged people to use him as a learning tool to avoid such issues.

He also touched on the challenges that people in his profession face from equipment, and copyright laws just to mention a few.

 

"Policies should be put in place to incorporate this new digital media era and how artists can make money because if I call an artist to ask for permission ni ngumu kuwafikia," Mutinda said as he urged the government to formulate policies that will ensure that there is a peaceful collaboration between musicians and social media content creators.

"We need to sit down as every stakeholder in the creative industry and have a discussion and see what can be done," finished off the Twitter big wig. 

Last year, Brian Mutinda, in an advert for TV manufacturing company Synix, used Nonini's legendary song 'Wee Kamu' in his content without permission from Nonini which landed him in problems with the law.

The veteran artist sued him and won with Mutinda being charged about one million Kenyan shillings. He said that the industry should learn from him and think before posting anything.

As he urged creators to be careful, and actively engage other people from musicians to dancers for consent just to be on the safe side.

Following his legal victory, Nonini shared his thoughts and responded as well to several fans about it.

"Lakini hope most Musician follow the lead. Make sure you copyright your material and get them split sheet's done. It's important #Mgenge2rGeneral." Stated Nonino before revealing that he'd been paid for damages plus cost of suit and interest.

  He further added that if approached nicely, he would allow people use his music for free during a sit down with G-Money.

"If you tell me you want me to allow you to use my songs for something, I might allow you to use it.," Nonini told G-Money.
